Islam has given both men and women the right to apply for divorce. Khula is Islamic divorce proceedings initiated by the wife in way of separation by mutual consent of both parties.

Faskh

Professional judicial annulment of the marriage contract.

Faskh is the annulment of a marriage by a Shariah Council, upon application by the wife when she wants to proceed with divorce, but the husband unreasonably refuses to grant the Talaq, effectively keeping her stuck in her marriage.

This refusal by the husband is contrary to the spirit of marriage and divorce as set out the Qur’an and hadith. We process Faskh and appoint a Qadhi (judge) to dissolve the marriage through a judicial annulment, bringing the marriage to an irrevocable end.
