The use of the website and services provided by the Muslim Family Centre is subject to the following Terms and Conditions:

Who we are

Muslim Family Centre is a service provider supported by Single Muslim; a company incorporated in under the laws of England.

Our contract

The Consumer Contracts Regulations 2013 require us to give you certain key information for there to be a legally binding contract between us. This information is set out below.

When placing an order, we will send you an email confirming receipt of your purchase and the details of your order. Your purchase represents an offer to us to which is accepted by us when we deliver confirmation of that order being accepted.

By using the Website and our Services, you agree to fully comply with and be bound by our Legal Terms. Please review them carefully. If you do not accept our Legal Terms, do not access and use the Website and the Services. If you have already accessed the Website or Services and do not accept our Legal Terms, you should immediately discontinue use of the Website or Services.

Muslim Family Centre reserves the rights to change these Terms and Conditions at any time by posting changes online. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified.

Content

We will take all reasonable care to ensure that all details, descriptions and prices of our services appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where item information has been mis-published, including prices and promotions.

You may not publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part, except as expressly permitted in this Agreement.

Your use

You agree to use this site only for lawful purposes and in a manner, which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the site by any third party.

You are allowed to view, download and print out content from this website for personal use only in accordance with these Terms. All other copying whether electronic, hard copy or other format is prohibited and all other rights are reserved.

Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.

We reserve the right to, without notice, withdraw the availability of this website or any of its content and/or any of its functions, information or services.

Application

During the order and application process you shall provide accurate, complete and updated application information. Failure to provide complete and accurate information may result in a rejection of your case, cancellation of your booking or an inability to provide the Services as requested.

Such failure may also result in loss or incorrect delivery of your order. In addition, failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your case and your access to our Services.

In the absence of fraud or manifest error, all our records relating to the Charges and Services are conclusive evidence of their accuracy and completeness.

Muslim Family Centre reserves the right to refuse application or access to the Services at its sole discretion.

Services

A service, or multiple services can be ordered and purchased from the Muslim Family Centre through the Website by choosing the type of services required and checking out using our payment provider.

We may change, suspend or discontinue any of the services at any time. We may, if ever required also impose limits or conditions on any of the services without notice or liability.

We do not guarantee that the services will always be available or uninterrupted. Muslim Family Centre will not be liable to you if for any reason the services are unavailable at any time or for any period.

Our responsibilities

The Muslim Family Centre is a progressive Muslim faith-based organisation which promotes fundamental Sharia based family practices and offers its services to the Muslim without prejudice or discrimination irrespective of creed, colour, gender, race etc.

The services provided deal with religious matters from the perspective of the Islamic faith. The Muslim Family Centre is here to help and advise you in matters relating to Sharia and family life.

Any service or information provided and or opinion expressed by the Muslim Family Council at any time, whether spoken or written in any format, including but not restricted to paper documents, website and email, is without obligation and on the understanding that any person who acts upon it or otherwise changes their position in reliance thereon, does so voluntarily and entirely at their own discretion and risk.

Any service, information, ruling, certification, advice and guidance provided, whether oral or written is solely from the perspective of the Islamic faith, based on the Qur’an and Sunnah, as understood by the recognised schools of thought and interpreted by the Muslim Family Centre. For matters pertaining to English law, we advise individuals to refer to a solicitor and or relevant authorities.

We fully endeavour to provide our services in good faith and bear no responsibility to any party who may or may not act on any information, advice, guidance or any service provided by the Muslim Family Centre at any time, and is hereby exempted from any loss, harm or damage howsoever caused, whether directly or indirectly and whether it is a financial loss or otherwise.

Your responsibilities

It is your responsibility to provide accurate and complete application information to us, and also inform us immediately if there are any changes to the application information

To follow the process and comply with all applicable laws, rules and regulations, and any requirements or restrictions pertaining and detailed for any of our services.

To comply with all instructions, notices or directions issued by us.

To abide by all copyright notices, trademark rules, information, and restrictions contained in the Website.

To not using or allowing the services to be used in any unlawful way or in a way that could give rise to civil or criminal liability, including posting, soliciting, transmitting or disseminating content which may be misleading, defamatory, offensive, indecent, objectionable or illegal, or which may cause annoyance, harassment or anxiety to anyone or doing anything, even if it is lawful, that we decide is harmful to our customers, operations, reputation, goodwill or customer relations.

You are responsible to pay all Charges even where there is any suspension, interruption or loss of the services provided.

Safeguarding

The Muslim family Centre has a duty of care in safeguarding all those who are deemed to be at risk of harm. The personal safety of our clients and service users and that of their families is paramount. We advise all applicants and respondents for marital arbitration, and the user of any other services generally, that if they have any concerns regarding their own or anyone else’s physical and or psychological well-being and safety, especially with regards to children, they should contact the relevant authorities in this regard, such as the social services, police etc.

Also, in order to safeguard its users, the Muslim Family Centre will refer all cases it deems necessary to the relevant authorities.

Civil Laws

The Muslim Family centre does not provide a parallel judiciary service and only aims to offer a mechanism for obtaining Islamic services which are religious obligations in Islam, and are not currently obtainable through the English courts and legal system.

The Muslim Family Centre maintains a policy of avoiding conflict between the law of the land and Islamic law in its deliberation.

Charges

Your payment details will be requested at the time of ordering your service.

Once you are registered for any part of the chargeable service, you must pay for the Charges for the said chargeable service thereto, even if they are used by someone else.

The prices for our services vary according to the Professional or the representative of the service being provided, the type and duration of the service you order, the location where the service is to be designated for the performance of it and the complexities of the communications with the other party to the case.

The Charges are liable to change at any time, but changes will not affect any orders which you have already made.

Additional Charges

There may at times be situations where additional services can be recommended to supplement your service and assist you to the required or desired outcomes. These will incur additional charges.

There may also be occasions where due to complexities of the case as well as communication issues with the other party to the case that additional charges for length of duration could be required. These will be communicated to you in good time and with good reason.

Timescales

The Muslim Family Centre endeavours to provide a fast and effective service to all our clients. Your individual case may take longer than advertised due to factors outside our control. All divorces start from the date the application is submitted.

We try to be as realistic as we can, but are unable to guarantee any timescale given as the service delivery depends on factors outside our control. Such as the time a divorce takes depends on the reliability of the parties and we cannot be held responsible for delays once your documents have been filed.

Please also bear in mind that if information is given incorrectly, we have to raise queries or the adjudication raise queries, this will cause delays. We therefore always advise that clients do not book events that may be directly tied to the production of a final decree until they are in receipt of the certificate.

Cancellation and refunds

Our services comply with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You have the right to cancel this contract within 14 days, a cooling off period to decide whether you wish to proceed with services supplied. The cancellation period will expire after 14 days from the day of the purchase of the service.

However, certain exemptions apply. If you have your application within the cooling off period, we will part refund you the price paid, less an administration charge for work carried out to the point of your request. These charges are available on request as different charges apply depending on the service purchased.

To exercise the right to cancel, you must inform us, of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or email). We will communicate with you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. email) without delay.

Termination

The Legal Terms shall remain in full force and effect while you use the services. We may terminate or suspend your access to the Muslim Family Centre services at any time, for any reason, and without notice or liability.

We may also terminate or suspend access to any and all of the services immediately, without prior notice or liability, if you breach any of the terms or conditions of the terms, including but not limited to:-

Where you provided incorrect, false or incomplete information to us;

Where we believe that you are likely to create imminent harm to the Muslim Family Centre or any of its service providers or systems or any persons or entity or our provision services, or to defraud us, or are likely to create imminent harm to others, or is to harass or are abusive to our personnel.

The Muslim family Centre shall not be liable for any damages, losses, costs or expenses of any nature suffered by you or third party resulting in whole or in part from the exercise of our rights under this Agreement. By using the Muslim Family Centre, you agree to waive and hold us and our partners, affiliates and service provider harmless from any claims relating to any action taken by us.

Policies

The Muslim Family Centre reserves the right to update, review, amend and change its procedures, policies, terms and conditions for any of its services, at any time and at its discretion and thus the definitive view of the Muslim Family Centre on any policy, procedure etc will only be that which is formally confirmed in writing by the Muslim Family Centre, as being the current and most up to date.

Warranties and Liabilities

This site and the information, names, images, pictures, logos regarding or relating to the Muslim family Centre are provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied.

While we endeavour to ensure that the information contained on this website is accurate, complete and up-to-date, we make no representations or warranties, whether express or implied, as to the accuracy, completeness or fitness for purpose of such information.

In no event will the Muslim Family Centre be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use or in connection with such use or loss of use of the site, whether in contract or in negligence.

The liability of The Muslim Family Centre for direct loss arising out of the use of the documents, this Web site, and the services whether based in contract, tort, strict liability or otherwise is limited to the total value of the transactions under which the claim arises for any one event or series of connected events.

The Muslim Family Centre does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the materials.

Indemnity

You agree to indemnify and hold The Muslim Family Centre and our affiliates, partners and service providers and our/their officers, directors and employees harmless from, including but not limited to all damages, liabilities, settlements, costs and attorney’s fees, claims or demands made by any third party due to or arising out of your access and use of the Website and the services for your violation of the Legal Terms.

You agree to defend and indemnify us from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, that arise from or relate to your use or misuse of or access to the services, and otherwise from your violation of the Legal Terms.

Security

When processing your order and completing your application for our services, you are agreeing to allow the Muslim Family Centre to use your personal data for the purpose of processing your service and case. For further information on privacy and security please see our Privacy Policy.

Intellectual Property

All copyright and all other intellectual property rights existing in this website (including, but not limited to, all design, text, graphics and the selection or arrangement thereof) are and remain the property of the Muslim family Centre.

You undertake that you shall not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, distribute, perform, display, or in any way exploit, any part of the Website and services, software and materials in whole or in part.

The Website may contain our trademarks as well as those of our Affiliates, our partners and our services providers, in the form of words, graphics, and logos. Your use of the Website and services does not constitute any right or license for you to use such trademark, without the prior written permission of the corresponding trademark owner.

Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this site or in respect to the services constitutes the entire agreement and understanding between you and us and govern your use of the services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.
